18 U.S.C. 2257 Statement of Exemption and Compliance

The operator of this website is a developer of online communities for gay men.   None of the visual depictions any visual depictions of actual sexually explicit conduct found on this website were produced by the website operator. Such images are provided from two sources: 1) Studios who producing erotic and sexually explicit videos and 2) Website Members who can upload images and video content associated to their profile (similar to Facebook, Myspace and other community websites).

1)  Adult Video Promotional Materials - Video Production Studios or their direct distributors have provided this website with images and embedded links to content for the promotion of their product.    The primary producers for each of these visual depictions have represented to the website operator that all models, actors, actresses and other persons that appear in any visual depiction of actual or simulated sexual conduct distributed through this website were eighteen (18) years of age or older at the time of the creation of such depictions.   Documentation required pursuant to 18 U.S.C. 2257 is maintained by the applicable Custodian of Records for the primary producer of each visual depiction and the Custodian of Records information is available through the affiliate links to buy or view each video.   This website is neither a primary or secondary producer of the images, nor do we directly sell them to website visitors.

2)  Member content - Registered members of this website have the ability to upload images and video for viewing in their profile. Within the meaning of SECTION 75.1(c)(4)(iv-v) this website is not a "Producer" because it "does not, and reasonably cannot" manage member uploaded content. This website makes no representation as to the source of member content. The operators of this web site rely on the plain language of the statute and on the well-reasoned decision of the United States Court of Appeals for the Tenth Circuit in Sundance Associates, Inc. v. Reno, 139 F.3d 804, 808 (10th Cir 1998). This case held, inter alia, that entities having no role in the "hiring, contracting for, managing, or otherwise arranging for the participation" of the models or performers, are exempt from the record-keeping requirements of 18 U.S.C. 2257. All visual depictions of actual or simulated sexually explicit conduct presented on this site have been uploaded by various third-parties ("Members") to Member Profiles or to the Photo Galleries. Member uploads are logged by User ID. 2257 Compliance remains the responsibility of the individual photographers and producers and the Members who upload these images.

In the website's User Agreement, members certify that all models in photographs and videos uploaded to this website were 18 years or older at time when the image was taken. Nothwithstanding the above, laws regarding child pornography and copyrights require this website to remove images which may appear to depict underage sexual conduct or which may violate a copyright. Removing such images does not constitute "management" as defined in SECTION 75.1(k).
